Article 1: Scope and Applicability

1.1 Purpose

These Warranty Terms and Conditions (hereinafter, the 'Warranty') detail the rights and obligations of both Numaru (hereinafter, 'Numaru' or 'we') and the purchaser (hereinafter, the 'Customer' or 'you') regarding any furniture sold and delivered by Numaru in Belgium, in compliance with applicable Belgian laws and European Union regulations.

1.2 Legal Framework

This Warranty is governed by Belgian law and takes into account the European Union consumer protection directives. It provides both the mandatory legal warranty and the commercial warranty offered by Numaru.

1.3 Non-Transferability

This Warranty is valid exclusively for the original purchaser and is non-transferable.

Article 2: Legal Warranty (Belgian Law)

2.1 Two-Year Legal Warranty

In accordance with Belgian law (Articles 1649bis et seq. of the Belgian Civil Code), all consumer goods are covered by a legal warranty of two (2) years from the date of delivery.

2.2 Presumption of Defect

If a defect arises within the first six (6) months of delivery, it is legally presumed to have existed at the time of delivery. Beyond the initial six (6) months, the Customer must prove that the defect existed at the time of delivery.

2.3 Notification of Defects

Customers must inform Numaru of any defects within two (2) months of discovering them. Failure to notify within this period may result in forfeiture of legal warranty rights.

2.4 Suspension of Warranty Period

If the product is repaired or replaced within the legal warranty period, the warranty timeline is suspended during the repair or replacement period. Once the product is returned or replaced, the warranty period resumes.

2.5 Right to Repair or Replacement

If the product is found to be non-conforming under the legal warranty, the Customer is entitled to have the product repaired or replaced free of charge. If such remedies are impossible or disproportionate, the Customer may request a price reduction or termination of the contract.

Article 3: Commercial Warranty (NUMARU)

3.1 Overview

Numaru extends a commercial warranty (hereinafter, the 'Commercial Warranty') beyond the mandatory legal warranty, offering additional coverage for defects in materials and workmanship under normal use.

3.2 Term of Coverage

  • Chair Frame (Laminated Bamboo): Seven (7) years from the date of delivery.
  • Cushions: Ten (10) years from the date of delivery.
  • Fabric: Standard coverage of two (2) years for fabric durability.

3.3 Nature of Coverage

Under this Commercial Warranty, Numaru will repair or exchange the product free of charge if a defect in materials or craftsmanship is found, provided that the defect is not excluded under Article 6 (Exclusions and Limitations).

3.4 Independence from Legal Warranty

This Commercial Warranty is provided in addition to the Customer’s statutory rights under Belgian law. It does not, in any way, limit or exclude the Customer’s right to invoke the legal warranty.

Article 4: Product Coverage Details

4.1 Frames

Our chair frames are constructed from high-quality laminated bamboo. Numaru guarantees that the frames will remain free from defects in materials and workmanship for a period of seven (7) years from the date of delivery.

4.2 Cushions

Numaru’s cushions are designed for a lifespan of approximately fifteen (15) years but are covered by a commercial warranty for ten (10) years from the date of delivery. This coverage applies to the foam or fill used within the cushions.

4.3 Fabric

The fabric on Numaru furniture is warranted for two (2) years against defects in materials and workmanship such as tearing or abnormal wear, under normal use conditions.

4.4 Legal Conformity

All product coverage herein is subject to the requirements that the product was used in accordance with Numaru’s guidelines and maintained properly (see Article 6 for exclusions).

Article 5: Claims Procedure

5.1 Filing a Claim

To file a warranty claim under either the legal warranty or this Commercial Warranty, the Customer shall:

  1. Contact: Email support@numaru.be.
  2. Provide Documentation:
    • Clear photographs of the damage or defect.
    • A detailed description of the issue and, if relevant, how it occurred.
    • Proof of purchase (e.g., receipt or invoice).
  3. Inspection:
    • A Numaru representative may visit the Customer’s location to assess the damage.
    • In some cases, the product may be picked up for further evaluation.

5.2 Timeline for Assessment

Numaru will acknowledge the claim within a reasonable timeframe. The period for resolution may vary depending on the complexity of the defect but will follow industry-standard practices for high-end furniture.

5.3 Repair or Exchange

  • If the claim is deemed valid under the warranty terms, Numaru may, at its discretion, repair the defective component or replace the entire product.
  • Repairs or replacements performed under warranty will not reset or extend the original warranty term beyond what is legally mandated (see Article 2.4 regarding suspension of the warranty period).

Article 6: Exclusions and Limitations

6.1 Normal Wear and Tear

This Warranty does not cover defects caused by normal wear and tear, including but not limited to slight fabric fading or minor cushion softening over time.

6.2 Improper Use or Accidents

Damage resulting from misuse, negligence, accidents, falls, impacts, commercial or rental use, or use in contravention of Numaru's guidelines is excluded.

6.3 Environmental Conditions

Damage caused by improper environmental conditions (e.g., excessive humidity, direct sunlight, or extreme temperature changes) is not covered.

6.4 Unauthorized Modifications

Any unauthorized modifications, alterations, or repairs performed by parties other than Numaru or its authorized agents void this Warranty.

6.5 Out-of-Scope Repairs

For defects not covered by this Warranty, Numaru may perform repairs at the Customer’s request and expense. The Customer will be provided with a cost estimate prior to any such repairs.

Article 7: Cooling-Off Period and Cancellations

7.1 14-Day Cooling-Off Period

Under EU consumer protection regulations, Customers who purchase products online have the right to a fourteen (14) day cooling-off period, during which they may withdraw from the purchase without penalty, provided the product is unused, in its original condition, and not a custom order.

7.2 Exemption for Custom Orders

Custom or bespoke orders, which are handmade according to the Customer’s specific requirements, cannot be canceled once the manufacturing process has commenced.

7.3 Return Process

For standard products eligible for return within the fourteen (14) day period, the Customer must contact Numaru at support@numaru.be to arrange the return. The Customer is responsible for return shipping costs unless otherwise mandated by law or agreed upon by Numaru.

Article 8: Customer's Duty To Report Defects

8.1 Timely Notification

The Customer must report any lack of conformity or defect within two (2) months of discovering it. Failure to do so may result in the loss of rights under both the legal and the Commercial Warranty.

8.2 Proof of Purchase

The Customer is responsible for providing proof of purchase to substantiate the warranty claim.

Article 9: Governing Law and Jurisdiction

9.1 Governing Law

This Warranty is governed by and construed in accordance with the laws of Belgium.

9.2 Jurisdiction

Any disputes arising out of or in relation to this Warranty shall be subject to the exclusive jurisdiction of the competent courts in Belgium.
